The issue is the term phone here. It assumes that the device has a
modem. Assuming an unlikely future where the modem firmware is fully
free on a smartphones with enough RAM to run modern GNU/Linux or
Android distributions, the tracking still remains.

People could not have any cellular modem and use the WiFi instead.
There are some places where there are community operated WiFi
networks. The MAC address would be changed at each connection,
roaming between WiFi AP would work, and people would use protocols
that don't require them to be always connected (allowing them to
change the MAC address). The battery could be bigger to compensate
for the power consumption. And as the WiFi firmware would be free
software we could still be able to optimize the power consumption.
