"freeware" is a problematic term in that it has no consistent
definition. This ROM image's source code appears to me to be non-free
software because its source code is (as far as I know) unavailable under
a free software license. This ROM image file (a binary) is non-free
because it may only be distributed non-commercially.
Is the source code for this ROM image available under a free license?
Can we make a new ROM image file from free source code?

A free program that requires non-free software to work is useless in the
free world. If there were a free replacement for the ROM image file, or
if the software in the ROM image were reimplemented and built into the
emulator so one didn't need that ROM image file at all, then this C64
emulator would be useful in the free world.
